| dc.description.abstract | This essay aims to unveil the theological aspects present in legal thought as a constitutive feature of its own functioning, demonstrating from language and political theology that Justice and Law are orders that do not keep any sense of belonging to each other. From Walter Benjamin's philosophy of history and language, I intend to articulate his messianic theology in such a way as to reveal the mythical rationality of Law in order to potentiate a discussion about justice and rights that can liberate them from the heritage of guilt. To this end, this monograph will investigate the interlocutions made by Benjamin regarding the centrality of language in the human relationship with the world, interpreting law as a plane of its irresolution and of the imprisonment of history by the mistranslation of social contents, culminating in the legal crystallization of surnamed versions of the historical struggles for rights. Thus, I intend to elaborate a conception of justice that moves from inside to outside of law; in a critical movement that can at the same time denounce the impossibility of its full realization within law, but also think of a political action capable of working at the limits of its fallibility, at the same time recognizing death and the finitude of living as presuppositions of a political happiness that is itself the historical and profane goal of the attentive critic, and enabling language and remembrance as categories that guarantee the possibility of this relationship. | en |
| dc.description.resumo | O presente escrito tem o intuito de desvendar os aspectos teológicos presentes no seio do pesamento jurídico como traço constitutivo de seu próprio funcionamento, demonstrando a partir da linguagem e da teologia política que Justiça e Direito são ordens que não guardam entre si qualquer senso de copertencimento. A partir da filosofia da história e da linguagem de Walter Benjamin pretendo articular sua teologia messiânica de forma a revelar a racionalidade mítica do Direito, a fim de potencializar uma discussão sobre justiça e direitos que possa libertá-los da herança da culpa. Para isso, esta monografia investigará as interlocuções realizadas por Benjamin a respeito da centralidade da linguagem no relacionamento humano com o mundo, interpretando-se o direito como plano de sua irresolução e de aprisionamento da história pela má tradução dos conteúdos sociais, culminando na cristalização jurídica de versões sobrenomeadas das lutas históricas por direitos. Assim, pretendo elaborar uma concepção de justiça que se movimente de dentro para fora do direito; em um movimento crítico que consiga ao mesmo tempo denunciar a impossibilidade de sua realização plena dentro do direito, mas também pensar em uma ação política capaz de trabalhar nos limites de sua falibilidade, ao mesmo tempo reconhecendo a morte e a finitude do viver como pressupostos de uma felicidade política que é por si só o objetivo histórico e profano do crítico atento, e habilitando a linguagem e a rememoração como categorias que garantem a possibilidade dessa relação. | pt_BR |
