dc.description.abstractThe article discusses the changing role of Brazilian municipal guards over time, with a special focus on the Municipal Guard of Belém. It notes the participation of these institutions in public security, going beyond their historical duties of protecting municipal property and services, especially in light of the increase in organized crime and the new interpretation of Article 144 of the Federal Constitution by the higher courts. The work is set in the context of Law 13.675/2018, which established the Unified Public Security System, and Action for Non-Compliance with Fundamental Precept 995, which consolidated the current scenario in 2023. The central problem is the mismatch between the historical and legal responsibilities of the institution and the growing demand for its actions in combating crime, driven by the complexity of organized crime. The main objective of this study is to analyze the structure, adaptations, and functions of the Municipal Guard of Belém in light of the new constitutional interpretation originating from the Superior Courts, and the practical consequences of this evolution on the public security system of the capital of Pará. To this end, the research was conducted through a review of bibliographic, legislative, and jurisprudential material relevant to the topic, and the methodology adopted followed a qualitative and bibliographic approach. The points indicated in the study permeate the history of Municipal Guards in Brazil and in Belém, the delimitations by doctrine, legislation, and jurisprudence, and the adaptations made over time. Finally, the study suggests that the role of Municipal Guards, especially in Belém, has expanded significantly beyond property protection. This expansion reflects a paradigm shift in which Municipal Guards are recognized as active agents in public safety, collaborating with other spheres and contributing to the reduction of crime.
dc.description.resumoO artigo expõe a modificação do papel das Guardas Municipais brasileiras ao longo do tempo, com enfoque especial na Guarda Municipal de Belém. Observa-se a participação dessas instituições na segurança pública, superando as suas atribuições históricas de proteção de bens e serviços municipais, especialmente diante do aumento da criminalidade organizada e da nova interpretação do Art. 144 da Constituição Federal pelos Tribunais Superiores. O trabalho se insere no contexto da Lei 13.675/2018, que instituiu o Sistema Único de Segurança Pública, e da Ação de Descumprimento de Preceito Fundamental 995, que consolidou o cenário atual em 2023. O problema central é o descompasso entre as atribuições históricas e legais da instituição e a demanda crescente por suas ações no combate à criminalidade, impulsionada pela complexidade do crime organizado. O principal objetivo do trabalho é analisar a estrutura, adaptações e as funções da Guarda Municipal de Belém à luz da nova interpretação constitucional oriunda dos Tribunais Superiores, e a consequência prática dessa evolução no sistema de segurança pública da capital paraense. Para isso, a pesquisa foi conduzida por meio de uma revisão em material bibliográfico, legislativo e jurisprudencial pertinente ao tema, e a metodologia adotada seguiu uma abordagem qualitativa e bibliográfica. Os pontos indicados no trabalho permeiam o histórico das Guardas Municipais no Brasil e em Belém, as delimitações pela doutrina, legislação e jurisprudência e as adaptações realizadas com o transcurso temporal. Por fim, o estudo sugere que a atuação das Guardas Municipais, especialmente a belenense, tem se expandido significativamente para além da proteção patrimonial. Essa expansão reflete uma mudança de paradigma, na qual as GMs são reconhecidas como agentes atuantes na segurança pública, colaborando com outras esferas e contribuindo para a redução da criminalidade.
